About Study Course

Objective

To develop students’ knowledge and ability to legally analyse and solve inheritance legal relations, identifying and applying the institutes and legal norms of inheritance law, using case law and legal doctrine, as well as to reasonably justify solutions to inheritance law problems.

Preliminary Knowledge

Introduction to Civil Law, Family Law.

Knowledge

1.The student knows and is able to define and characterize the basic concepts, principles, sources and institutes of inheritance law, as well as the rights and obligations of the participants in inheritance legal relations. The student knows and is able to explain and distinguish between the legal regulation, prerequisites and legal consequences of statutory, testamentary and contractual succession.

Skills

1.The student identifies and analyses the factual circumstances and legal problems of legal succession and determines the applicable legal norms. The student interprets and applies the norms of succession law using legislation, case law and legal doctrine.

Competences

1.The student independently solves cases in the field of inheritance law, linking the factual circumstances with the applicable inheritance law institutes and legal norms and formulating legally justified conclusions. The student evaluates alternative solutions to inheritance legal relations and argues his or her legal position, including in situations where it is necessary to link several inheritance law institutes.

1. Test work/test on the institutes of inheritance law and inheritance legal relations. Individually perform a written test work/test on the institutes of inheritance law and inheritance legal relations studied in the study course. The tasks test the student's knowledge of the concepts of inheritance law, types of inheritance, institutes of inheritance law, their legal regulation, preconditions for application and legal consequences. Written test work/test within the framework of a practical class. Time for completion - up to 90 minutes. The work is done individually, without the help of other persons or auxiliary means. The work is done for full-time attendance - during the practical class specified in the study course implementation plan, for part-time attendance and distance learning - within the term specified in e-studies. The following are evaluated:

  • knowledge and legally accurate characterization of the concepts and institutes of inheritance law;
  • knowledge of the norms of inheritance law and their content;
  • distinction between the preconditions and legal consequences of legal, testamentary and contractual succession;
  • determination of the rights and obligations of the participants in inheritance legal relations;
  • legal precision and completeness of the answers.

Case study

Analysis of a case in succession law. Individually perform a written analysis of a case in succession law, identifying legally significant factual circumstances and legal problems, determining the applicable succession law institutes and legal norms, interpreting and applying them to the specific factual circumstances, formulating a legally argued solution and conclusions, as well asin class to justify and defend their legal position by answering questions and engaging in a discussion on possible alternative solutions. Written analysis of the case and its oral defence within the framework of the lesson. Time for completion - up to 90 minutes for the written part; oral defence - within the framework of the lesson (full-time studies), part-time and distance learning - written part to be developed within the time limits specified in estudijas, oral defence - during the lesson. The work is carried out individually. In solving the case, it is allowed to use regulatory enactments. The student must justify the solution with the legal norms applicable in the particular situation andbe able to defend the chosen solution in the class..Criteria for award:

  • Written analysis of the case and formulation of a legally justified solution – 40 %– identification of the relevant factual circumstances and legal issues, determination and application of the applicable succession law institutes and legal rules, reasonableness of the conclusions.
  • Oral argument and defence of legal positions – 60 %– ability to explain and justify the chosen solution, to answer questions in a reasoned manner, to react to counter-arguments and to evaluate possible alternative solutions to the case.

Examination

50.00% from total grade

Individually take a written exam consisting of two theory questions and a case in the law of succession. In the theory questions, the student characterizes the institutes of the law of succession, their legal regulation, content and legal consequences, while in the solution of the case, he identifies the legally relevant factual circumstances and the applicable institutes and legal norms of the law of succession, applies them and argues the legal solution. The time of execution - according to the schedule of examinations of the study course. The duration of the exam is 90 minutes. The exam is taken individually without the use of regulations, legal literature, case law, study materials and other sources of information. Assessment criteria: In the theoretical part, the completeness, systematicity and legal accuracy of the knowledge is assessed; in the practical part - the identification and application of legally relevant circumstances and applicable institutes and legal norms of the law of succession, the validity of legal argumentation and conclusions. A prerequisite for a successful exam assessment is the completion of both parts of the exam at a satisfactory level.

If an unsatisfactory assessment is obtained in the exam, the exam is not passed, an unsatisfactory final assessment is given.
